SUNNY VILLAGE CAFÉ, LLC.

PLAY AREA RULES and PARTICIPATION AGREEMENT

So as to maintain as safe and enjoyable environment for our guests and their children, SUNNY VILLAGE CAFÉ, LLC., requests the Parents/Guardians of children being admitted to
our play area to read and sign this participation agreement and otherwise familiarize themselves
with the attached Rules of the Play Area for the safety and enjoyment of the children at our facility.

The undersigned, for myself, my child/children or ward/wards for whom I am the parent or
legal guardian acknowledge receipt of the Play Area Rules and Participation Agreement and
confirm that I have read and signed this document in consideration of the opportunity for my
child/children or ward/wards to use the facility, or to participate in any activities at SUNNY
VILLAGE CAFE, LLC.

I, for myself, my child/children or ward/wards acknowledge and understand that despite the
facility’s best efforts to maintain a safe environment, hazards may still exist inherent to general
play areas and associated with the activities at/by SUNNY VILLAGE CAFE, LLC. that are purely
accidental and otherwise impossible to avoid in their entirety.

I, for myself, my child/children or ward/wards agree to be respectful of others and to the staff of SUNNY VILLAGE CAFÉ, LLC. and to specifically follow the safety instructions and
rules stated herein and acknowledge that failure to do so may result in one or more of my children
or wards being required to leave SUNNY VILLAGE CAFE, LLC. without warning and without
refund for any amounts paid to SUNNY VILLAGE CAFÉ, LLC.

I hereby grant SUNNY VILLAGE CAFÉ, LLC., or its authorized representatives, contractors and licensees, the right to make visual recordings, audio recordings, still images, and/or to otherwise capture material of me and/or my minor child(ren) or ward(s) under my care at the time the material is collected and agree that the material will become the property of SUNNY VILLAGE CAFÉ, LLC. and will not be returned. I agree that SUNNY VILLAGE CAFÉ, LLC. and its assigns and licensees have the right to reproduce, prepare derivative works of, distribute or display, sell and use these materials in whole or in part, for government or non-government purposes, in any manner or media (whether now existing or created in the future), in perpetuity, and in all languages throughout the world including, but not be limited to, audiovisual programs; museum exhibits; Web sites; publications; product artwork; mobile phone applications and project publicity. I waive the right to inspect or approve any use of the material and any right to royalties or other compensation arising or related to the use of the material
and I agree to indemnify, hold harmless, and release and forever discharge SUNNY VILLAGE CAFÉ, LLC. from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons active on my behalf or on behalf of my estate have or may have by reason of this authorization.

I, for myself, my child/children or ward/wards, and on behalf of their heirs, assigns, personal
representatives and next of kin, to the extent permissible under applicable law, HEREBY HOLD
HARMLESS SUNNY VILLAGE CAFE, LLC., its owners, members, officers, employees,
equipment manufacturers and sponsoring agencies from all liability for any such personal injury
or other form of loss or damage suffered by any child/children or ward/wards participating in any
activities in the Play Area.

I, for myself, my child/children or ward/wards understand that my execution of this
Participation Agreement on the initial visit will authorize SUNNY VILLAGE CAFE, LLC. to
enter this document into its database and use it as a continuous, multi-use agreement and
acknowledgment for my child’s/children’s ongoing participation in the activities at the facility
upon future visits. I hereby expressly authorize SUNNY VILLAGE CAFE, LLC. to rely upon its
use of this Participation Agreement for any and all future visits until such time as I revoke it in
writing.

PLAY AREA RULES

OF SUNNY VILLAGE CAFÉ, LLC.

• No shoes or bare feet allowed past the entrance gate (children AND adults).
• Respect Play Area property.
• Use equipment as-intended, appropriately and safely.
• Leave all toys, games, and personal items at home
• Children are to be supervised generally by their Parent or Guardian at all times.
• Parents/Guardians are not to leave children unattended beyond their line of site while in
the Play Area.
• Parents/Guardians are not to leave the building without their children or wards for any
reason.
• Children will use appropriate language at all times.
• Hitting, kicking, wrestling, rough-housing and play fighting and unsafe play are
not allowed.
• Children must not leave gated area without their parents/guardians
• Children are allowed to make positive comments only to peers (no put-downs).
• No chase or tag games allowed.
• No running allowed
• Only children under 2 years old are allowed in the sectioned-off baby area.
• Food and drink must stay on the seating side of the cafe (not the carpeted play area), unless
it has a lid or cover.
• No outside food or drink, besides baby food and water or any specialized/allergy-friendly
snack for your child
• Do not attend/participate if you are feeling ill
• No jumping off the jungle gym.
• Go down the slides feet-first, one person at a time.

• No toys to be brought up onto the play gym

• During play hours open to the general public, Participants are prohibited from hosting
private parties (birthday etc.) or engaging in activities that would be exclusive to a limited
number or group of participants.
